Official Rules Instant Karma Sweepstakes

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION.

Sponsor.  The “Sponsor” of this promotion is Credit Karma, LLC, P.O. Box 30963, Oakland, CA 94604. This promotion is in no way sponsored, endorsed or administered by, or associated with a social media platform (including but not limited to Facebook, Inc.).

Promotion Period. This promotion begins at 6:00 am Pacific Time (“PT”) on Monday, November 1, 2021, and ends at 11:59 pm PT on Tuesday, November 30, 2021 (the “Promotion Period”). Sponsor’s computer is the official time-keeping device for the promotion.

Eligibility. In order to be eligible, entrants must be (a) at least the age of majority in their jurisdiction of residence; and (b) a legal resident of the 50 United States (except for Florida and New York), including Washington, DC. Residents of Florida and New York are not allowed to participate and will not be eligible. VOID WHERE PROHIBITED.

How to Enter. During the Promotion Period, an entrant may enter using one of the following two methods:

  1. Debit Card Entry: During the Promotion Period, an eligible entrant may enter this Promotion by using his/her Credit Karma Visa® Debit Card to make a qualifying purchase (“Debit Card Entry”). Entrant will receive one entry per qualifying purchase. A qualifying purchase is a purchase that has been processed and accepted by the merchant and has settled in the entrants Credit Karma Money Spend account. This purchase may, but not necessarily, include tips, holds, and deposits related to the qualifying purchase. In addition, Sponsor reserves the right to disqualify any entrant whose transaction is rescinded, withdrawn, not completed, or otherwise not finalized prior to the awarding of a prize. The entrant’s debit card must remain active, and entrant’s Credit Karma Money Spend account must remain open and in good standing through the Promotion Period and the awarding of the prizes.
  2. Mail-In Entry: An eligible entrant may enter this Promotion without a Credit Karma Visa Debit Card and without making a purchase. To enter by mail (“Mail-In Entry”), an entrant must send a slip of paper with entrant’s name, home address, phone number, and email address by mail to Sponsor at Credit Karma, LLC, P.O. Box 937 Pineville, NC 28134-0030. Each entry must be on a separate slip of paper. Mail-In Entries must be hand-written and original. Limit 10 Mail-In Entries per outer mailing envelope. Outer mailing envelope must include “Instant Karma entry”. For winner selection purposes, Mail-In Entries will be deemed made on the day they are post-marked. If you would like to have your Mail-In Entry eligible for a Promotion Day that falls on a day in which the United States Postal Service does not deliver mail, for example Sundays or holidays, you must additionally write on the Mail-In Entry slip of paper (i) either “Sunday” or the name of the weekday the holiday falls on (for example, you would write “Thursday” to enter a Promotion Day that fell on Thanksgiving) and (ii) the date in MM/DD/YY format of the Promotion Day you would like to enter, and your Mail-In Entry must be post-marked no later than the first business day following the requested Promotion Day. Mail-In Entries must be post-marked by the end of the Promotion Period, and received no later than seven days after the close of the Promotion Period.  

Conditions Applicable to All Entries. Any use of robotic, repetitive, automatic, programmed, script, macro, or any other automated means or similar entry methods or agents (including, but not limited to, contest-entry services or multiple or different email addresses, identities, registrations or logins) is prohibited and will void all entries submitted by that entrant if discovered by Sponsor. Entrants must use their own name. Sponsor reserves the right in its sole discretion to disqualify any entry at any time that in Sponsor’s opinion does not comply with these Official Rules. Sponsor is not responsible for lost, incomplete, damaged, illegible, late, postage-due, or misdirected entries, or for errors in mechanical transmission, unavailability of phone lines or connections, cellular phone service, or any other technical malfunctions or inability to transmit messages or entries. Received entries become the property of Sponsor and will not be returned or acknowledged.

Winner Selection. This is an instant-win Sweepstakes, and Debit Card Entry winners will be selected at randomly designated times throughout the Promotion Period (each, a “Winner Selection Window”). Each Promotion Day will be divided into four six-hour time periods as follows: 12:00:01 a.m. UTC to 6:00:00 a.m. UTC; 6:00:01 a.m. UTC to noon UTC; 12:00:01 p.m. UTC to 6:00:00 p.m. UTC; and 6:00:01 p.m. UTC to 11:59:59 p.m. UTC (the “Day Segments”). There will be at least one Winner Selection Window in each Day Segment. The first eligible Debit Card Entry received after a Winner Selection Window opens will be designated a potential winner. If a new Winner Selection Window opens before a winner has been designated for a prior Winner Selection Window (i.e., there were no eligible Debit Card Entries for the prior Winner Selection Window), the first eligible Debit Card Entry received in the new Winner Selection Window will be deemed the winner for the prior Winner Selection Window, and the next eligible Debit Card Entry received in the new Winner Selection Window will be deemed the winner for that Winner Selection Window. Sponsor may, at its sole discretion, allocate additional bonus prizes (“Bonus Prizes”) per Day Segments. If a Bonus Prize is allocated to a Day Segment, a second Winner Selection Winner will open in that Day Segment, and the Bonus Prize winner will be selected as set forth above. Sponsor will not provide notice of the addition of Bonus Prizes. There may be multiple Bonus Prizes allocated to a single Day Segment. Mail-In Entries will be selected based on equal (or better) odds that applied to the Debit Card Entries for each Promotion Day. To select Mail-In Entry winners, Sponsor will first allocate Mail-In Entries by their designated Promotion Days, which will be determined by the post-mark date or, if so designated on the Mail-In Entry, a particular Sunday or holiday during the Promotion Period. Sponsor will then calculate the number of Debit Card Entries on a given Promotion Day and divide that number by the total number of prizes (regular prizes and Bonus Prizes, if applicable) on that Promotion Day. Sponsor will then apply that ratio to the number of Mail-In Entries received for that Promotion Day to determine the number of Mail-In Entry prizes available for that Promotion Day and the odds of winning for each Mail-In Entry. For example, if there are 100 Debit Card Entries on a Promotion Day and four Debit Card Entry Prizes, the odds of winning for a Mail-In Entry will be, at worst, one in 25.  A potential winner can be a Winner, whether a Debit Card Entry prize winner or Mail-In Entry prize winner, only once per Promotion Day.

Winner Notification, and Verification. Sponsor will attempt to notify the potential winners in app, by email, or by phone within one to three days for Debit Card Entry winners, although it is expected most winners will be notified less than an hour after completing their Debit Card Entry, and within 10 to 14 days for Mail-In Entry winners, from when the eligible entry is received. Each potential winner must respond to the initial notification attempt within five business days. Sponsor is not responsible for lost, delayed, misdirected, or returned prize notifications. Awarding of prize is subject to verification of eligibility and compliance with these Official Rules. Potential prize winners may be asked to complete, sign, and return the Affidavit of Eligibility, Waiver of Liability and Publicity Release form (TN residents need not sign Publicity Release) and, if so, do so within five business days of the time Sponsor sends such document to winners. By signing and returning an Affidavit of Eligibility, Waiver of Liability, and Publicity Release, winners agree to be subject to a personal background check. All activity arising out of and relating to the Promotion, including any reference to an entrant’s status as a “winner,” is subject to verification and/or auditing for compliance with the Official Rules, and by participating in the Promotion entrants agree to cooperate with Sponsor concerning such verification and/or auditing. Potential winners also may be required to provide certain tax documents. By entering or accepting the prize, each winner consents to Sponsor’s use of his or her name, photograph, likeness, voice, opinions, information, biographical information, hometown and jurisdiction of residence for publicity and promotional purposes without further compensation where permitted by law. (TN residents need not so consent.) If a potential winner is not in compliance with these Official Rules, if a potential winner does not respond within five business days of first notification attempt, if a prize notification or attempted notification is returned as undeliverable, if a potential winner is deemed ineligible for any reason, if a potential winner fails to sign and return required documents and provide required identification by the deadlines established by Sponsor, or if a potential winner declines prize offered, the prize will be forfeited and will not be awarded. 

Prizes.  Each winner who entered through the Debit Card Entry will receive the amount of the winning Debit Card Entry transaction, which will be awarded in the form of a reimbursement to the winner’s Credit Karma Money Spend account. For example, if the winning Debit Card Entry transaction was a purchase for $92.80, the winner will receive a reimbursement of $92.80. Prizes will be awarded based on the settled transaction amounts of the qualifying purchase, so prize amounts may not necessarily include tips, deposits, or holds. The minimum Debit Card Entry prize is $1. For example, if the winning Debit Card Entry transaction is $0.89, the winner will receive a $1 reimbursement. The maximum Debit Card Entry prize is $5,000. For example, if the winning Debit Card Entry transaction is $5,010, the winner will receive a $5,000 reimbursement. Each winner who entered through the Mail-In method of entry will receive the amount of the average winning Debit Card Entry prizes awarded for the Winner Selection Windows that day. For example, if there were 10 Debit Card Entry prizes awarded in a given day, and the average amount of the prize was $50, then a Mail-In Entry winner for that day will receive $50. Prizes awarded to Mail-In Entry winners will be awarded in the form of checks mailed to the mailing address provided by winner in connection with the Mail-In Entry. No substitution, assignment or transfer of the prize is permitted, except by Sponsor, which has the right to substitute the prize with another of comparable or greater value. Sponsor will not replace a lost or stolen prizes. Each winner is responsible for all taxes and fees associated with the receipt and/or use of the prize. All properly claimed prizes will be awarded, but in no event will more than the stated number of prizes be awarded. If production, technical, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

Conditions of Participation. By submitting an entry for this Promotion, you agree to abide by these Official Rules and any decision Sponsor makes regarding this Promotion, which Sponsor will make in its sole discretion. Sponsor reserves the right to correct typographical, printing, or clerical errors in any Promotion-related materials and to make other changes that do not materially affect the substance of the Official Rules. Sponsor reserves the right to prohibit any entrant from participating in the Promotion if, at its sole discretion, Sponsor finds such entrant to be tampering with the entry processor the operation of the Promotion, or if such entrant shows a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner the Sponsor determines to be not fair or equitable; (b) in an annoying, threatening, or harassing manner; or (c) in any other disruptive manner. If a dispute arises regarding compliance with these Official Rules, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor’s control, but Sponsor shall not be obligated to consider any data or other information collected from any other source. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay, or omission by Sponsor in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Sponsor’s right to assert or rely upon any such provision or right in that or any other instance. If there is any conflict between any term of these Official Rules and any of the entry or marketing materials used in connection with the Promotion, the terms of these Official Rules will govern.

Disclaimer, Release and Limit of Liability. SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE PROMOTION. BY ENTERING THE PROMOTION, EACH ENTRANT AGREES TO RELEASE AND HOLD HARMLESS FACEBOOK, INC., INSTAGRAM, TWITTER,  SPONSOR, AND THEIR SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS, AND EACH OF THEIR RESPECTIVE PARENTS, AFFILIATES, AND SUBSIDIARIES AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING OUT OF PARTICIPATION IN THE PROMOTION OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. If Sponsor terminates the Promotion, it will determine the Debit Card Entry winner for the Winner Selection Window that is open at the time of termination as set forth above or, if it is not possible to choose a Debit Card Entry made after a Winner Selection Window opens, it will select the last valid, non-suspect Debit Card Entry received prior to the termination, provided it is able to do so. Sponsor will not select any additional Debit Card Entry winners. Sponsor will select Mail-In Entry winners for every Promotion Day up to and including the day the notice of termination is posted by random drawing from among all eligible, non-suspect entries received and designated for those Promotion Days, if it is possible to do so. Sponsor will determine number of Mail-In Entry prizes, odds of winning, and Mail-In Entry prize values by applying the methodology set forth above. If Sponsor terminates or modifies the Promotion, Sponsor will post notice on the official Promotion website.

Privacy and Use of Promotion Information. Sponsor collects personal information from you when you enter this Promotion. Sponsor reserves the right to use any information collected in accordance with its privacy policy, which may be found at https://www.intuit.com/privacy/statement/

GOVERNING LAW AND DISPUTES.  ANY CONTROVERSY OR CLAIM ARISING OUT OF, OR RELATING TO, THESE OFFICIAL RULES AND THE PROMOTION (“CLAIM”) IS GOVERNED BY THIS SECTION, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA, AND THE FORUM AND VENUE FOR ANY DISPUTE WILL BE IN THE COUNTY OF SAN FRANCISCO, CALIFORNIA. IF THE CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT MUST THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”).
