The divorce decree states that she reponsible for payments and is to sell or refinance the house once our daughter graduates from high school which happened this month. This would remove my name from the mortgage. She is thinking of walking away from the mortgage because the house is worth $80k less than what she owes. What can I do?

Contact the mortgage company, and then go online to your credit reports to file dispute. submit that information that you would like the file reviewed that your name was removed from the loan. if the mortgage wont remove it the Credit Bureau will have to, if they can not verify when your name came off the loan. Most likely the positive of ever having a mortgage will be removed but the far more damaging negatives will me gone.

Take her back to court if she does not comply! There should be a way for the courts to give you some kind of paper work to submit to the credit agencies to notify them that the judge had ruled the mortgage HER SOLE responsibility! You also may be able to sue her for damaging your credit further even after a court has ruled against her. Check with your lawyer he may know some1 or have better resources for you. Best of Luck!
