Lender not applying full pymt to acct and reports acct as deliquent even though pd on time/in full

I have been paying my mortgage on time and in full, but my lender has not been applying my full amount to my account for the past year. I have repeatedly questioned them on it and was told that it would be fixed. My credit is totally wrong because they are reporting me late/delinquent. I have sent in my payment confirmations and proof that I have paid on time, but they are still showing me as late.

I would file a complaint with the attorney general in your state or theirs and maybe a BBB complaint also(BBB is mostly worthless though). If that is not resolved I would suggest contact an attorney using the naca.net site. Remember that if you do need to litigate against them you need to place those tradelines with the credit bureau in dispute first else you will have no cause of action. I would do that asap and get that AG complaint out. I had a mortgage company do that to me and they jerked us around and I just mauled them in court to the tune of 19 grand. Don't be a victim.

I have repeatedly disputed the reporting and the response I get is always the same that the record is accurate which not so. I have contacted the BBB and am still awaiting a response. This has been going on for a year, but I haven't recieved a foreclosure notice go figure. I would have thought that if I wasn't paying I would have recieved something by now.

Given the political attention mortgages have, I would also send letters to my congressmen, as well.

In general, what your bank is doing is illegal. This violates rules as put down through multiple federal regulatory agencies (FHA, FDIC, SEC) and there can be severe and significant penalties for violating these. And, chances are, you aren't the only person they are doing this too, and they probably do not want their books reviewed at their own expense.

I'd file complaints with these agencies, as well as those outlined by camalott4.

if charges to your escrow account have gone up (such as property tax or insurance) It will cause your monthly payment to go up in order to compensate for the difference. The lender will always pay up the escrow before it applies anything to the actual loan. Your mortgage payment should change annually(at least a little)due to these fluctuations.

My loan is not escrowed. I pay taxes/ins at the end of the year.
