Legal but not smart.

If you borrow the money for a down payment, you will have that loan PLUS a mortgage to repay.  Better to save up for a down payment.

As already said, not a good idea at all. If you cannot afford to come up with a down payment, you cannot afford to have both a mortgage and payment for the money borrowed for a down payment. Wait until you have money saved up, so you have some breathing room.
